Terms of use

Provider

RedSwiss Wealth (wealth-pms.redswiss.ch) is operated by Anthony Thomas, a private individual resident in Switzerland. Contact: info@anthony-thomas.ch.

Purpose

RedSwiss Wealth is software for independent asset managers: client files, multi-currency portfolios, valuation, reports and a client portal. These terms apply to any use of the service.

A tool, not a financial service

RedSwiss Wealth provides no investment advice, manages no assets and holds no funds. Valuations are calculated from the data you enter and from reference exchange rates: they are indicative and do not replace your custodians' statements.

Your professional obligations

You alone are responsible for meeting your regulatory and professional obligations, in particular under the Financial Institutions Act (FinIA), the Anti-Money Laundering Act (AMLA), the Financial Services Act (FinSA) and professional secrecy, including the rules on outsourcing. It is up to you to check that using the service is compatible with these obligations.

Your clients' data

You are responsible for the data you enter about your clients. You warrant that you are entitled to process it and have informed the people concerned. We process it only on your behalf, to provide you with the service, as described in the privacy policy.

Account

You provide accurate information, keep your credentials confidential and are responsible for actions taken from your account and by the members of your firm. We recommend enabling two-factor authentication.

Use of the service

You use the service lawfully. Using it for fraudulent purposes or to infringe the rights of others is prohibited.

Plans and payment

A free plan and paid plans are offered as shown on the Pricing page. Paid plans are billed in advance for each period and paid through Stripe.

You can cancel at any time; cancellation takes effect at the end of the current, already paid period, which is not refunded unless required by law. We may change prices with at least 30 days' notice.

Availability

We do our best to keep the service available and reliable, but we do not guarantee uninterrupted availability, in particular during maintenance or outages.

Liability

To the extent permitted by law, our liability for slight negligence is excluded. It is never excluded for intent or gross negligence (art. 100 of the Swiss Code of Obligations). We are not responsible for investment decisions made on the basis of the information displayed, or for the data you enter.

Ending use

You can stop using the service at any time and request deletion of your account at info@anthony-thomas.ch. Export any data you need to keep beforehand. We may suspend or close an account if these terms are breached.

Changes

We may change these terms. For significant changes we will inform you in advance by email or on the website. If you keep using the service after the changes take effect, you accept them.

Governing law and jurisdiction

These terms are governed by Swiss law. The place of jurisdiction is the provider's place of residence, subject to mandatory places of jurisdiction under the law, in particular for consumers.
